Terms of Use
Last updated: 28 July 2026
These terms apply when you use ToiletNearMe Australia. By using the site you accept them. If you do not accept them, please do not use the site.
The site is free
ToiletNearMe Australia is free to use. There is no account, no subscription and no payment. We may change, suspend or withdraw any part of the site at any time without notice, and we do not promise that it will always be available.
Where the data comes from, and its limits
Toilet locations and facility details on this site come from the Australian Government’s National Public Toilet Map, a third-party open dataset published on data.gov.au. See our Data Sources page for the full attribution and licence.
We did not survey these toilets ourselves. We reproduce what the dataset says, and the dataset has known gaps. Please read the following as a plain statement of fact, not as boilerplate:
- Records can be out of date. A toilet may have been closed, demolished, relocated or rebuilt since the dataset was last updated.
- Opening hours are frequently incomplete or wrong, and seasonal, holiday and event closures are generally not reflected at all. A toilet shown as open may be locked when you arrive.
- Accessibility details — wheelchair access, MLAK locks, adult change tables, hoists, door widths, grab rails, baby change facilities — are recorded inconsistently across councils. A missing field means “not recorded”, not “not present”, and a recorded field may no longer be accurate.
- Some entries describe toilets inside private premises, such as shopping centres or service stations, where access depends on the operator, on trading hours, or on being a customer.
- Coordinates can be imprecise, and distance calculations are approximate.
Do not rely on this site alone for accessibility needs
If you have an accessibility requirement, a medical condition, a continence need, or you are travelling with someone who does, please treat this site as a starting point and confirm before you travel. Call the council, the venue or the facility operator, and confirm that the toilet exists, that it is open, and that the specific feature you need is present and working. If you rely on an MLAK key, confirm that the lock is an MLAK lock and is maintained.
In an emergency, or where being unable to find an accessible toilet would put your health or safety at risk, do not rely on this site. Contact the venue, the council or emergency services directly.
No warranty
The site and its content are provided “as is” and “as available”. To the maximum extent permitted by law, we make no representation and give no warranty that the information is accurate, complete, current, or fit for any particular purpose, and we exclude all implied warranties.
Nothing in these terms excludes, restricts or modifies any consumer guarantee, right or remedy you have under the Australian Consumer Law that cannot lawfully be excluded. Where we are permitted to limit our liability for breach of a consumer guarantee, our liability is limited to resupplying the relevant service or paying the cost of having it resupplied.
Limitation of liability
To the maximum extent permitted by law, we are not liable for any loss, cost, inconvenience, injury or damage arising from your use of, or reliance on, this site — including travelling to a toilet that turns out to be closed, missing, inaccessible or different from what is described, and including any indirect or consequential loss. Your remedy if you are dissatisfied with the site is to stop using it.
Acceptable use
You agree not to:
- Use the site or its data for any unlawful purpose, or in a way that harms, harasses or endangers anyone.
- Scrape, crawl or bulk-download the site at a rate that degrades it for other people, or attempt to bypass rate limits or spam protection.
- Interfere with, probe or attempt to gain unauthorised access to the site or its systems.
- Submit false, abusive or misleading content through the contact form.
- Misrepresent this site as an official government service, or imply that we endorse you.
The underlying toilet data is open data and remains available under its own licence, which we set out on the Data Sources page. Our page layouts, written guides and other original content on this site remain ours.
Links to other sites
We link to councils, government pages and other external sites for reference. We do not control them and we are not responsible for their content or their privacy practices.
Reporting an error
If you find a toilet listed here that is wrong, closed or missing, please tell us through the contact page. Corrections help everyone, and we act on them.
Changes and governing law
We may update these terms from time to time; the date at the top shows when they last changed, and continuing to use the site means you accept the current version. These terms are governed by the laws of Australia.
